Tenant caused fire damage. So it would depend on how the tenant s phone charger caused the fire for example. The simple fact that a fire occurred is not adequate grounds for a lawsuit and tenants can sue their landlords for damages that the tenants incur as a result of fires. If the renter s insurance covers damage to the premises caused by the tenant s negligence you should be able to recover from the policy up to the policy limits. Assuming the tenant s negligence was the cause of the fire the tenant should be responsible for the damage.
Anything beyond the policy limits would be the responsibility of the tenant. A tenant who causes a fire may be responsible to the landlord for amounts in addition to rental payments. From there it will go on a case by case basis for recouping the cost of fire damages from there. If a fire is caused by a landlord s negligence the landlord may be liable for the tenant s inconvenience lost wages damaged personal property and lost perishable food.
If the tenant has renter s insurance they can follow their insurance company s procedure to file a claim against any property loss or damage caused by the fire. Damage that cannot be classified as wear and tear but is also not caused by the tenant their guest or negligence about the maintenance is the landlord s responsibility. Typically these are structural repairs plumbing electrical wiring gas appliances.
